Acceptance of Terms

These Terms of Service (“Terms”) govern your access to and use of the website located at thechutecompany.com (the “Site”) and any trash or linen chute cleaning, odor control, unclogging, inspection, repair, replacement, installation, maintenance, code compliance, post-fire remediation, or related services (collectively, the “Services”) provided by The Chute Company (“The Chute Company,” “we,” “us,” or “our”).

By requesting a quote, booking a service, submitting a form on the Site, approving a proposal, or otherwise using the Services, you (“Customer” or “you”) agree to be bound by these Terms. If you do not agree, please do not use the Site or the Services.

Description of Services

The Chute Company provides commercial trash and linen chute services, including but not limited to:

  • Trash and linen chute cleaning
  • Chute odor control
  • Chute unclogging
  • Chute inspections and code compliance services
  • Chute door repair and replacement
  • Chute system repair and maintenance
  • Trash and linen chute installation
  • Post-fire chute remediation
  • Related chute and waste-system services

Specific service scope, pricing, availability, exclusions, and project requirements are described on the relevant service pages of the Site and/or in your quote, proposal, work order, or service agreement. Scope and pricing may vary based on the property, system condition, accessibility, location, equipment requirements, and other site-specific conditions.

Quotes, Bookings, and Scheduling

Quotes provided through the Site, by phone, electronically, or in person are based on the information available at the time and may be subject to change following an on-site inspection or discovery of conditions that were not reasonably apparent when the quote was prepared.

Appointments and projects are scheduled based on technician, crew, equipment, and property availability. We will make reasonable efforts to perform Services within the agreed scheduling window; however, weather, traffic, access restrictions, emergencies, prior project overruns, equipment requirements, or other circumstances outside our reasonable control may result in delays.

You are responsible for providing safe and reasonable access to the property and all relevant areas of the chute system at the scheduled service time. This may include chute intake doors, discharge rooms, trash rooms, roof access, mechanical areas, loading areas, or other portions of the system necessary to complete the Services.

If our technicians cannot safely access or complete the Services due to circumstances outside our control, additional trip, labor, equipment, or rescheduling charges may apply.

Pricing & Payment

Pricing for Services is provided at the time of quote, proposal, booking, or service agreement and may vary based on property type, chute configuration, number of floors or intake doors, condition of the system, service frequency, labor requirements, equipment, materials, disposal requirements, travel, and additional requested Services.

Payments may be processed through third-party payment providers depending on the payment method selected. Your use of those providers may also be subject to their respective terms and privacy policies.

Payment is due according to the schedule specified in the applicable quote, proposal, invoice, or service agreement unless otherwise agreed to in writing.

Additional work requested by the Customer or required because of conditions discovered after work begins may require a revised quote, change order, or additional authorization before the work is performed.

Service Scope & Site Conditions

The Chute Company will perform the Services described in the applicable quote, proposal, work order, or service agreement.

Conditions concealed within walls, chute shafts, mechanical areas, inaccessible portions of the system, or other areas that cannot reasonably be inspected before work begins may affect the scope, duration, or cost of the Services.

Repairs, replacements, modifications, demolition, electrical work, fire-protection work, structural work, or other services that are not specifically included in the approved scope are not included unless authorized separately.

Inspections & Fire Code Compliance

When The Chute Company performs a Fire Code Inspection, the inspection is conducted to determine whether the accessible components of the chute system comply with the applicable fire code requirements within the scope of the inspection.

Upon completion of a Fire Code Inspection, The Chute Company will identify any deficiencies that must be corrected. If the system passes the inspection, The Chute Company guarantees that the inspected components of the chute system comply with the applicable fire code requirements covered by the inspection as of the date the inspection is completed.

If deficiencies are identified, the system will not be considered compliant until the required corrective work has been completed and, when applicable, the affected components have been reinspected.

This guarantee applies only to the components and conditions included in the inspection and that were accessible at the time of inspection. It does not apply to concealed conditions, subsequent alterations or damage, conditions arising after the inspection date, or portions of the property outside the chute system and the agreed inspection scope.

Where applicable, final approval or acceptance by the local Authority Having Jurisdiction (AHJ), fire marshal, building official, or other governmental authority remains subject to that authority’s own inspection and determination.

Customer Responsibility

You agree to:

  • Provide accurate information when requesting a quote or scheduling Services.
  • Disclose known hazards, damage, system failures, fire damage, hazardous materials, or unusual site conditions.
  • Provide safe and reasonable access to the areas necessary for our technicians to perform the Services.
  • Obtain any property, management, tenant, building, or other permissions required for us to access and perform work at the property.
  • Keep work areas reasonably accessible and free from preventable hazards.
  • Notify us of building-specific safety, access, parking, loading, elevator, or security requirements before the scheduled service.

Exclusions & Limitations of Service

Standard chute cleaning, inspection, maintenance, or repair services do not automatically include removal or disposal of hazardous or regulated materials, chemicals, biological waste, large furniture, electronics, construction debris, or other prohibited materials unless specifically included in the applicable written scope.

Certain conditions may require specialized contractors, licensed trades, engineering review, fire-protection professionals, environmental services, or other third parties.

Emergency or after-hours Services may carry different pricing, availability, response times, and service conditions, which will be communicated when the Service is requested.

Third-Party Services

The Site may use third-party tools for forms, analytics, scheduling, payment processing, communications, or other website and business functions.

Your interactions with those third-party services may also be governed by the respective provider’s terms and privacy policies.

Intellectual Property

All content on the Site, including text, graphics, logos, photographs, videos, designs, downloadable materials, and other content, is the property of The Chute Company or its licensors unless otherwise stated and may not be copied, reproduced, distributed, modified, or commercially used without prior written permission.

Limitation of Liability

To the fullest extent permitted by applicable law, The Chute Company will not be liable for indirect, incidental, special, consequential, or punitive damages arising from use of the Site or Services.

The Chute Company is not responsible for pre-existing conditions, concealed defects, inaccessible portions of a chute system or property, damage caused by third parties, or conditions outside the scope of the Services described in the applicable quote, proposal, work order, or service agreement.

Nothing in these Terms is intended to exclude or limit liability where such exclusion or limitation is prohibited by applicable law.

Indemnification

You agree to indemnify and hold harmless The Chute Company, its owners, employees, agents, contractors, and representatives from claims, damages, liabilities, or expenses arising from your breach of these Terms, misuse of the Services, failure to disclose known hazards, or failure to obtain required authorization for Services performed at a property, to the extent permitted by applicable law.

Governing Law

These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-law principles.

Any disputes arising under these Terms shall be resolved in the state or federal courts located in Harris County, Texas, unless otherwise required by applicable law.

Changes to These Terms

We may update these Terms from time to time. Continued use of the Site or Services after changes are posted constitutes acceptance of the revised Terms.

The “Last updated” date at the top of this page reflects the most recent revision.
